This was a point that was brought up (and shot down) during Kyle's case. Kyle was trying to leave and lowered his rifle in an attempt to flee. |

His mom can come. Mr. Brooks is left as a possible witness. Going over the defendant rights to testify, and States right to cross examine and ask about prior crimes. In prep for Monday review with him. Failure to answer is a NO. |

With "blah blah blah" defendants the judge should just let them go until they're tired and give it to the jury. Throwing the defendant out of the court room is just asking to have issues on appeal.

State anticipates no rebuttal.
Still need to do jury instruction on Monday. Tuesday: Jury instructions will take past lunch( starting in the morning.) State: Patterson has never wrote Brooks. Brooks has called her 37 times , she has never answered. Photos were given to a third party, then to the mom. |
