I remember this as well, but I think during the arguments the prosecution was filibustering, trying to massage the court with his slimy arguments.  With the time running late, I think the judge wanted to cool off before hammering out a mistrial then and there. It’s my understanding the bald defense attorney (not a slam, I don’t recall his name) suggested they would file that motion officially with the court asking for a mistrial with prejudice.

If defense rests tomorrow, it’s possible the judge could rule on the defense motion to declare a mistrial/prejudice.  Everyone goes home for the weekend, justice upheld.

Wishful thinking on my part, unfortunately, although I pray that happens.

It is a sad state of affairs in our society that when the commie mobs came to burn our cities that it was left to a 17 year old kid to stand up to them because our political leaders and law enforcement abandoned us.

Kyle Rittenhouse is not the only one on trial, we all are on trial and our ability to defend ourselves from commie mobs.  This is a political persecution that reaches far beyond one kid.

Zimiski stepped towards KR from between the cars and instructed Rosenbaum to “get him and kill him” as testified by Kyle.  It would seem likely that KR would instinctively bring his rifle to bear on Zimiski if Zimiski had his gun out while approaching KR.  I thought Kyle already admitted to this during direct, but I didn’t rewatch it.

Then... KR already testified he pointed his rifle at Rosenbaum and it did not deter the charge.  KR retreated again until the he was cornered, turning around finally shooting the attacker who was close enough to grab his rifle.

I meant that the defense already moved for a mistrial (with prejudice), not that the judge had granted it... yet.

IIRC, court is in session today despite it being Veterans Day.  The judge mentioned near the end of the day if they didn't hold court today, they'd have to have court Saturday to try and meet the courts schedule of this going to the jury by Tuesday.  I think that was when he took the "vote" among the lawyers.

So far the DA is going hard in the paint and winning the battle between himself and the court process. He’s gotten two things in front of the jury that the court doesn’t allow and so far has gotten away with it….regardless of the “yelling judge”.

I thought he lived with the grandma and brother he threatened with the knife, and grandma's sister who testified recently moved to Kenosha to help take care of grandma, but visited often when he was a child.

I still think "so you're saying he never threatened your sister with a skateboard because there were knives in the house?" was a valid cross-exam question, if the great aunt was on the stand to tell us how he'd never attack people with a weapon and the knife was already proven in court.

The vote was for keeping closing arguments on schedule, with enough time for the rebuttal.  It had nothing to do with Veterans Day.  The question was if they wanted to “guarantee” a Tuesday (or even Monday) finish, they might have to be in court on Saturday.  They decided that there was enough time during regular hours, could finish Tuesday instead of an accelerated Monday schedule, and Saturday would not be needed.

The ADA team were douches  during that segment as well.

PhD program in accounting, I had a prof who would tell the class (seminar) when and where to meet him in the bar Thursday night. I don't do bars.

Judge can order MISTRIAL after jury returns verdict.

Very likely the judge is waiting to see what the jury does before ruling.

Mistrial based on prosecutor's grievous constitutional abuse is moot if jury rules NG on all counts.

Moreover, if jury renders NG on some counts, same applies. Jeopardy attached, and NG counts cannot be retried.

Prosecutor knows how well and truly fucked he is. It's either acquittal on all counts, or prosecutor has to start over on any counts where jury renders guilty verdict.


I was wondering about that, if the jury voted guilty if the judge could go "lol no, dismissed".

Worse optics than a Walmart red dot.  The judge is already being accused of steering the trial in KR's favor; do this and the country will be in flames by spring.

I'm not necessarily opposed.  The trial itself, from the events leading up to it to the manner in which it's playing out, is a clear illustration of a society on the verge of collapse.  We all know what's coming.  

It is my understanding that the defense is going to submit that the judge declare a mistrial over the prosecution's shenanigans, with prejudice, so they cannot retry the case.  It's also my understanding that the judge can issue this ruling AFTER the defense rests.

It would be the proper thing to do, considering the circumstances, in my non-professional opinion, but my faith in the justice system doesn't allow me to get excited about this prospect.

I don't think there is going to be any nationwide riots over this, even if the judge sets aside the verdict (directed verdict.) It was a white kid greasing other white dudes. POCs aren't going to stick their necks out for a couple of ofay fellow travelers.
